1. Agreement to Terms

By accessing or using Portugal Lifestyle ("the Platform," "our Service," "we," "us," or "our"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not access or use our services.

These Terms constitute a legally binding agreement between you and Portugal Lifestyle. We reserve the right to modify these Terms at any time, and continued use of the Platform after changes constitutes acceptance of the modified terms.

2. Description of Service

Portugal Lifestyle provides an online Portuguese learning platform featuring:

• Interactive games and exercises for vocabulary, grammar, and pronunciation
• Over 2,000 vocabulary words with audio pronunciation
• AI-powered conversation practice and pronunciation analysis
• Cultural content including stories, phrases, and Portuguese lifestyle topics
• Digital PDF guides about Portuguese culture and language (available for purchase or as referral rewards)
• Progress tracking and statistics
• Referral program (for yearly subscribers)

3. Eligibility

You must be at least 13 years of age to use our services. By using the Platform, you represent and warrant that you meet this age requirement. If you are under 18, you must have permission from a parent or legal guardian to use our services.

4. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Keep your password secure and confidential
• Notify us immediately of unauthorized access
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion.

5. Subscription Plans and Pricing

5.1 Subscription Types

We offer the following subscription plans:

• Monthly Subscription: Billed monthly with full access to platform features
• Yearly Subscription: Billed annually with full access plus eligibility for our referral program

5.2 Billing and Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date. You authorize us to charge your payment method on file for the renewal amount. Prices are subject to change with 30 days' notice.

5.3 Payment Processing

All payments are processed securely through Stripe. By providing payment information, you authorize us to charge the applicable fees to your payment method. You are responsible for paying all fees and applicable taxes.

5.4 Failed Payments

If a payment fails, we may retry charging your payment method. If payment continues to fail, your subscription may be suspended or canceled, and you may lose access to premium features.

6. Cancellation and Refunds

6.1 Subscription Cancellation

You may cancel your subscription at any time through your account settings or the Stripe billing portal. Upon cancellation:

• You will retain access until the end of your current billing period
• Your subscription will not renew for the next period
• No refund will be provided for the remaining time in your current billing period
• You may lose access to premium features and content

6.2 Account Deletion

If you delete your account, you will immediately lose access to all content, progress data, and purchased materials. Deleted accounts cannot be recovered. No refunds will be issued upon account deletion.

7. Digital PDF Guides

PDF guides purchased through our platform or earned through referrals are digital products subject to the following:

• All PDF guide sales are final with no refunds
• PDF guides are for personal, non-commercial use only
• You may not distribute, resell, or share PDF guides with others
• We grant you a non-exclusive, non-transferable license to access PDF guides
• PDF guide downloads may be limited to a certain number of times

8. Referral Program

8.1 Eligibility

The referral program is exclusively available to active yearly subscribers. Monthly subscribers are not eligible to participate in or receive referral rewards.

8.2 How It Works

• Generate a unique referral code or link from your account
• Share your referral link with friends and family
• When someone uses your code to purchase a yearly subscription, you earn rewards
• Rewards include €5 credit (up to €50 maximum) and free PDF guides from our collection
• Credits are automatically applied to your Stripe customer account and will reduce your next renewal payment

8.3 Referral Discount

New users using a referral code receive 25% off their first yearly subscription (€52.49 instead of €69.99).

8.4 Restrictions and Abuse

We reserve the right to:

• Void referral rewards obtained through fraud, misrepresentation, or manipulation
• Suspend or terminate accounts engaged in referral abuse
• Modify or discontinue the referral program at any time
• Set limits on rewards (e.g., €50 credit cap, 8 PDF guide maximum)

8.5 Credit Usage

Referral credits have no cash value and cannot be transferred, sold, or redeemed for cash. Credits automatically apply to future invoices and expire if your yearly subscription is canceled or not renewed.

9. Intellectual Property Rights

All content on the Platform, including but not limited to text, graphics, logos, audio files, games, PDF guides, and software, is the property of Portugal Lifestyle or its licensors and is protected by copyright, trademark, and other intellectual property laws.

9.1 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes in accordance with these Terms.

9.2 Restrictions

You may not:

• Copy, modify, or distribute Platform content without permission
• Reverse engineer, decompile, or disassemble any software
• Remove copyright or proprietary notices
• Use automated systems (bots, scrapers) to access the Platform
• Create derivative works based on our content
• Share your account credentials with others

10. User Conduct

You agree not to:

• Use the Platform for any illegal or unauthorized purpose
• Violate any laws, regulations, or third-party rights
• Upload malicious code, viruses, or harmful content
• Harass, abuse, or harm other users
• Impersonate others or provide false information
• Interfere with or disrupt the Platform's operation
• Attempt to gain unauthorized access to our systems
• Use the Platform to spam, phish, or distribute unwanted content

11. Third-Party Services

Our Platform integrates with third-party services including:

• Stripe: Payment processing
• Firebase: Authentication and database
• OpenAI: AI conversation features
• Elevenlabs: Audio generation

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.

12. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that:

• The Platform will be uninterrupted, secure, or error-free
• Content will be accurate, complete, or up-to-date
• You will achieve specific learning outcomes
• Defects will be corrected

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PORTUGAL LIFESTYLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER IN CONTRACT, TORT, OR OTHERWISE, ARISING FROM:

• Your use of or inability to use the Platform
• Unauthorized access to your account or data
• Errors, interruptions, or service disruptions
• Third-party content or conduct

Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim, or €100, whichever is greater.

14. Indemnification

You agree to indemnify, defend, and hold harmless Portugal Lifestyle and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:

• Your violation of these Terms
• Your use of the Platform
• Your violation of any rights of another party
• Your violation of applicable laws or regulations

15. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause or notice, including for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Extended inactivity
• Discontinuation of the Platform

Upon termination, your right to use the Platform ceases immediately. Sections of these Terms that by their nature should survive termination will remain in effect.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Portugal.

17. Dispute Resolution

Before filing a legal claim, you agree to attempt to resolve disputes informally by contacting us at portugallifestyleapp@gmail.com. We will work in good faith to resolve disputes amicably.

18. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use after changes constitutes acceptance of the modified Terms.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Portugal Lifestyle regarding use of the Platform and supersede all prior agreements.
